KAIRO NEWS – Sacked MP Seeks Removal Injunction


Hon. Ya Kumba Jaiteh has not only challenged the revocation of her National Assembly nomination she also wanted the Supreme Court to order an injunction on the swearing of Foday Gassama. Mr. Gassama, the former Regional Coordinator of the United Democratic Party, was nominated to replace Hon. Jaiteh.

In her civil suit, Ya Kumba Jaiteh was convinced that President Adama Barrow has no constitutional powers to revoke her nomination. She wanted the the Supreme Court to rely on Section 127 of the Constitution to declare the revocation of her case nomination null and void.

The Clerk and the Speaker of the National Assembly, Foday Gassama and the Attorney General have been sued as the first, second, third and fourth defendant, respectively.

The plaintiff was on Monday represented by a team of lawyers led by Bory S. Touray while Binga D. and N. Jarju appeared for the first, second and fourth defendants.

In his application, Lawyer Touray urged the court to treat his client’s pending motion dated the 5th March 2019 with urgency.

However, the attorney for the defendants asked the court to give him two days to reply to the motion, considering the fact that he was served on March 8th. and he needs two days to reply on the said motion. His application was not objected by the plaintiff’s counsels and the court granted the application. Lawyers for the plaintiff did not file objection.

The case was djourned to Thursday, March 14 the when a hearing of the motion would take place.
